Who I work for

Each sector is photographed its own way: a flat for rent is not shot like a shop or an outlet

Villa drawing room with Venetian terrazzo floor, open green shutters and lake view
Living room of a period apartment with herringbone parquet, grey sofa and French windows, evening light
Enfilade of empty rooms through a double door, afternoon sun on the parquet floor
Living room with kitchenette in a 1970s one-bedroom apartment, foggy day

Houses and flats

For sale and for rent. Agencies, private owners, developers

People looking for a home look at the pictures before anything else. If they show the space properly, the viewing books itself

  • Light, space and the character of every room
  • 360° tours for buyers looking from abroad
  • Delivery in 24-48 hours, files ready for the portals

What you rarely find

The 360° tour and the drone work are not a service added last month: I have been doing both for ten years

Panoramas built by hand

For ten years I have built tours frame by frame: historic buildings, churches, theatres, hotels and factories. The difference shows on a large screen

Flying since 2015

Ten years of aerial work over houses, hills and businesses, long before drones became common. I know where flying is allowed and where it is not

The tour stays yours

No subscription and no monthly fee. The file is yours: it keeps working when you change website or agency

One shooting day, from the air to the detail

Scroll and fly with me through a villa. This is what really happens in a day of shooting

Choose where to fly
Lake among the mountains at dawn seen from a drone, mist on the water and a villa garden with cypresses and a jetty
Stone terrace on the lake in the morning with a laid table, lantern, jetty and wooden motorboat
Villa drawing room with Venetian terrazzo floor, olive velvet armchairs, marble fireplace and French window overlooking the lake
Villa bedroom at sunrise with walnut wardrobe, writing desk and French windows open onto the misty lake
Villa bathroom with a stone bathtub in front of the French window overlooking the lake, walnut vanity unit and travertine top
Villa dining room at sunset with walnut table, olive velvet chairs, persimmons and kitchen with travertine island
Lake among the mountains at blue hour seen from a drone, jetty and garden with cypresses lit by lanterns
01 / 07

I take the drone up over the lake

From above I film the lake, the mountains and the garden on the water: you see at once where the house is

02 / 07

I come down to the terrace

The drone drops towards the jetty and the laid table. This is the picture people remember

03 / 07

I go into the living room

I shoot from the tripod: straight lines, shutters open and the lake framed in the windows

04 / 07

The bedroom at sunrise

I wait for the sun to reach the bed and photograph the room in that light

05 / 07

The bathroom with a view

I frame the bathtub so that the window overlooking the lake is in the shot too

06 / 07

The dining room at sunset

The low sun lies across the table. I shoot while the light is warm

07 / 07

Blue hour: the drone takes off

The lights come on along the jetty. The last shot of the day is from the air

Vineyard hills in autumn at dawn with mist in the valleys and a small stone house among the rows of vines, drone shot
Open window with green shutters in a stone wall and a bedroom with a wrought-iron bed in the first morning sun
Small country kitchen with wooden beams, stone sink, table for two, grapes and wine, windows overlooking the vineyards
Living room of a small stone house with a lit fireplace, linen sofa, leather armchair and vineyards at blue hour
Small bathroom in a stone house with glass shower, stone washbasin and windows overlooking the vineyards in the mist
Stone terrace under a vine pergola at sunset, table for two with wine and a lantern, vineyard hills
Vineyard hills at blue hour seen from a drone, lit villages on the ridges and mist in the valleys
01 / 07

I take the drone up over the hills

I film the vineyards and the fog in the valley: the place sells the house before the rooms do

02 / 07

I fly up to the window

The drone looks in through the open window: the bed in the first morning sun

03 / 07

I photograph the kitchen

I lay the table with grapes, wine and chestnuts. The house looks lived in, not empty

04 / 07

Evening by the fire

I light the fire and the lamps; outside the sky is blue. This photo opens the listing

05 / 07

The small bathroom

I photograph the shower and the basin with the windows looking onto the vines: bright, clean, shown at its real size

06 / 07

The terrace under the pergola

Sunset, two glasses, a lantern on the table. I photograph the reason people come here

07 / 07

The drone climbs into the evening

The villages light up on the hills. One last shot from the air, and the flight is over

Outlet village in autumn seen from a drone at dawn, mist over the fields, vineyards and snow-capped Alps
Pedestrian avenue of an outlet village with yellow ginkgos, fallen leaves, street lamps and pots of heather
Outlet village square with autumn display: pumpkins, straw bales, apples and a pergola of red vines
Ceramics and textiles shop with white walls, wooden table, bowls and linen napkins
Knitwear shop with sweaters folded on a wooden table, throws, beanies and wool socks
Arcaded gallery of an outlet village after the rain, wet stone, lit shop windows and yellow leaves
Outlet village at sunset seen from a drone, yellow poplars, ploughed fields and pink Alps with the first snow
01 / 07

I take the drone up over the outlet

Morning fog, fields and the Alps: from above you see the whole shopping village

02 / 07

I fly down the avenue

The drone flies low over the yellow leaves between the shop windows, before anyone arrives

03 / 07

The autumn piazza

Pumpkins, apples, red vine leaves. I photograph the display while it is fresh

04 / 07

The tableware shop

From the tripod I photograph a bright room: shelves, napkins, maple branches at the window

05 / 07

The knitwear shop

Jumpers, blankets, hats. I set the light so that you can feel the wool

06 / 07

The arcade after the rain

The wet stone reflects the shop windows. I shoot before it dries

07 / 07

Sunset over the Alps

The drone climbs higher and the snow on the mountains turns pink. The last shot of the day

About

Aleksandr Goncharov — photography, video, drone and 360° tours

Twenty years of looking at things carefully, ten of them from above as well

I started in news, where a photograph works on the first frame or it does not exist: nobody stops a match so you can try again. Twenty years on, I work the same way in houses, hotels and companies and at the sports grounds of northern Italy, and the same holds when I shoot video or fly the drone. Prepare first, work at the hour when the light helps, deliver on the day that was promised

Northern Italy since 2026

  • Houses, short lets, hotels, outlets and sport
  • Photography, video, 360° virtual tours and drone footage: one supplier, one day

How I work

Preparation

Before I pick up the camera I know what is needed, who it is for and where it will end up

The right hour

A facade is photographed when the sun rakes across it, not whenever I happen to pass

Discretion

People living, working or receiving guests in the space carry on doing so while I work

I keep my word

The delivery date is written in the contract, and I keep to it

In practice

Italian VAT number

A written contract and an electronic invoice for every job

Authorised to fly

Registered and insured operator, flight zones checked before signing

Where I work

I work mainly in Piedmont, Lombardy and Liguria. Anywhere in Italy by arrangement

With love for Italy, since 2026

I chose Italy with my heart. Here the light works with you: a stone facade changes character three times between morning and evening, and whoever buys, rents or books looks closely at the photographs before making a move. I was welcomed by a country that cares about its own things — its houses, its villages, its tables laid properly — and to this country I dedicate my work. Every picture I make is a way of thanking Italy and giving back a little of the beauty it shows me every day

Common questions

Do you charge for the first visit?

No. We look at the property together by phone or WhatsApp and the quote arrives within three days

How fast do you deliver?

From 24 hours to 7 days depending on the job: a flat in 24-48 hours, a hotel or a large property in 3-7 days. 24-hour delivery costs 50% more

Can the drone fly anywhere?

No. Flight zones are checked before signing. Where outdoor flight is not allowed, indoor shots with a light drone remain possible

Do you work outside the three regions?

Yes, across Italy. Beyond 30 km only the travel cost is added

Do you issue an invoice?

Yes. An Italian electronic invoice, as with any Italian supplier. I am on the flat-rate regime, so no VAT is charged: the agreed price is what you pay

Can the images be used anywhere?

Yes: for your site, portals, social media and print. They stay yours

What happens to the data of people who visit this site, in plain words

01

Data controller

The data controller, within the meaning of Article 4(7) and Article 13 of Regulation (EU) 2016/679, is:

Trading name: DAMONTE Aleksandr Goncharov

Owner: Oleksandr Honcharov, photographer, sole trader

VAT number: 02820200067

Registered address: Via Alcide de Gasperi 12, 15069 Serravalle Scrivia (AL), Italia

Email: info@damonte.net

Telephone: +39 351 412 3949

Requests concerning the protection of personal data are to be addressed to info@damonte.net or to +39 351 412 3949.

The controller’s Italian tax code appears in contracts and invoices and is not published on this site.

No data protection officer has been appointed, the conditions set out in Article 37(1) of the Regulation not being met.

No data protection officer has been appointed: none of the cases in Article 37 of the Regulation applies, since this is not a public authority and there is no large-scale processing and no processing of special categories of data.

02

Data collected while you browse

The hosting provider’s systems record, for as long as is technically necessary to run and protect the site, the data that internet protocols inevitably carry: IP address, date and time of the request, page requested, browser type and operating system.

This data is not used to identify the user and is not combined with other information. It serves solely to deliver the page, to produce aggregate load statistics and to detect any abuse.

03

Data provided by the data subject

The site contains no contact forms: no data is collected through its pages.

The WhatsApp and email buttons open external applications. The data the data subject chooses to communicate there — name, contact details, information about the property or the business — is processed in order to answer the enquiry, draw up the quotation, conclude the contract and issue the invoice.

A conversation on WhatsApp takes place on the platform of WhatsApp Ireland Limited, which processes the data as an independent controller under its own notice, outside the controller’s control.

04

Local storage in your browser

The site records two entries only in the browser’s local storage: dm_lang, which holds the selected language, and an entry recording that the notice at the foot of the page has been read.

These are technical entries: they remain on the data subject’s device, are transmitted neither to the controller nor to third parties, and permit no identification. They may be removed at any time through the browser settings.

05

Purposes and legal bases

Running and securing the site: the controller’s legitimate interest in providing a working, protected site, Article 6(1)(f) of Regulation (EU) 2016/679.

Answering enquiries, quotations and negotiations: steps taken at the request of the data subject prior to entering into a contract, Article 6(1)(b).

Contract, invoicing and accounting: performance of the contract and compliance with legal obligations, Article 6(1)(b) and (c).

Publication in the portfolio of the images produced: consent of the data subject, Article 6(1)(a), revocable at any time.

06

Retention periods

Server logs: as long as technically necessary, normally no more than a few days, unless an offence is being investigated.

Messages and quotes that led nowhere: twenty-four months, then deleted.

Contracts, invoices and accounting records: ten years, as Italian tax law requires.

Images published on the basis of consent: until consent is withdrawn, whereupon they are removed from the site.

07

Categories of recipients

The hosting provider, appointed as a processor: Google Ireland Limited (Firebase Hosting), Gordon House, Barrow Street, Dublin 4, Ireland.

The accountant and, where mandatory, the Italian Revenue Agency and other public bodies required by law.

The provider of the automatic assistant: OpenAI Ireland Limited, Dublin, Ireland, appointed as a processor under Article 28 of the Regulation.

The provider of the infrastructure that forwards the assistant’s messages: Cloudflare (Cloudflare, Inc. and Cloudflare Germany GmbH), also a processor.

Where the data subject chooses to use WhatsApp, the conversation passes through WhatsApp Ireland Limited, which acts as an independent controller under its own notice.

Data is never sold, never passed on for commercial purposes, and never used for profiling or automated decision-making.

08

Transfers outside the European Union

The site makes no calls to external services: typefaces, images, scripts and virtual tours are all served from the site’s own domain.

The chosen providers are European companies and processing normally takes place within the European Economic Area. Some technical operations may nevertheless involve their parent companies in the United States.

Those transfers rest on the European Commission’s adequacy decision of 10 July 2023 on the EU-US Data Privacy Framework and, additionally and independently, on the standard contractual clauses of Implementing Decision (EU) 2021/914. A copy of the safeguards can be requested at info@damonte.net.

09

Rights of the data subject

The data subject has the right to obtain access to the data concerning them, rectification, erasure, restriction of processing and portability, and to object to processing based on legitimate interest, under Articles 15 to 22 of the Regulation.

Where processing is based on consent, that consent may be withdrawn at any time, without prejudice to the lawfulness of processing carried out before withdrawal.

Requests are to be sent to info@damonte.net. A reply is provided within thirty days.

10

Complaint to the authority

A data subject who considers the processing unlawful may lodge a complaint with the Italian supervisory authority, Garante per la protezione dei dati personali, Piazza Venezia 11, 00187 Rome, or bring proceedings before the courts.

11

Images produced for the client

Photographs produced for a client are not published in the portfolio in the absence of written consent, obtained separately from the contract and revocable at any time.

Where recognisable individuals appear in the images, publication is conditional upon a specific release being obtained.

12

Minors and amendments to this notice

The site is not directed at children under sixteen and does not knowingly collect their data.

This notice may be updated. The version published on this page, bearing the date stated there, is the version in force.

13

Whether provision of data is required

Consulting the site requires no data to be provided. Navigation data is nevertheless technically necessary for the page to be transmitted to the data subject’s device.

A quotation presupposes contact details and the essential information about the property: failing those, the enquiry cannot be answered. An invoice presupposes the tax details prescribed by Italian law: failing those, the work cannot be invoiced and consequently cannot be carried out.

14

Security measures

Messages and files are kept on devices protected by passwords and full-disk encryption, with a separate backup.

Access is limited to the controller. No outside collaborator receives a client’s material without the client being told.

The site is served only over an encrypted HTTPS connection.

In the event of a personal data breach presenting a risk to the rights and freedoms of the data subject, the data subject is notified without undue delay and the supervisory authority is informed within seventy-two hours, under Articles 33 and 34 of the Regulation.

15

Processors and sub-processors

The hosting provider is appointed as a processor in writing under Article 28 of the Regulation, and may use sub-processors already authorised in its own agreement.

The accountant handles tax data as a controller in their own right, to meet the obligations the law places on them.

An up-to-date list of processors is available on request at info@damonte.net.

16

Automated decisions and profiling

No profiling is carried out and there is no automated decision-making within the meaning of Article 22 of the Regulation.

The calculators on the site, including the light calculator and the quotation calculator, operate entirely in the data subject’s browser: the values entered are neither transmitted, stored nor analysed.

17

The 360° virtual tours

The tours published on the site are hosted on the controller’s own domain. Opening one entails no request to any third-party service: images, viewer code and typefaces are served from damonte.net.

A tour does not load automatically: until the still is pressed, the page carries a photograph and nothing else. On opening, the viewer records certain viewing settings on the device, such as camera position and navigation mode; those entries remain in the browser, are transmitted to no one, and are removed together with the site data.

In two tours an element links to a video on YouTube. This is a hyperlink and not embedded content: it opens in a new tab only upon the user’s action, and from that point the terms and notice of YouTube (Google Ireland Limited) apply, outside the controller’s control.

18

The automatic assistant

The site provides an automatic assistant, which starts solely upon the user’s action. Until then the page makes no call to any external service.

The text of messages sent to the assistant is transmitted to a technical service of the controller and from there to OpenAI Ireland Limited, which produces the reply as a processor under Article 28 of Regulation (EU) 2016/679, on the basis of a data processing agreement. The provider does not use that content to train its models.

The conversation is not retained: no archive of sessions exists, either on the site or with the controller. The text remains in the browser tab for the duration of the session. The provider retains requests for a limited period, for technical purposes and to counter abuse.

At the end of the conversation the assistant prepares a summary and opens WhatsApp with the text pre-filled. Sending it remains the user’s decision; from that point the provisions on WhatsApp messages apply.

The legal basis is the controller’s legitimate interest in answering enquiries promptly and, where the enquiry concerns a quotation, steps taken at the request of the data subject prior to entering into a contract: Article 6(1)(f) and (b) of the Regulation.

Users are advised not to enter unnecessary data into the assistant, in particular identity documents, payment data, information relating to third parties and special categories of data within the meaning of Article 9 of the Regulation.

The assistant is an automated system and declares as much before every conversation, as required by Article 50 of Regulation (EU) 2024/1689. It takes no decisions concerning the user and produces no legal effects: it qualifies the enquiry and passes it to a natural person.

Alongside the transparency duty under Article 50 of Regulation (EU) 2024/1689, Italy adds Article 13 of Law no. 132 of 23 September 2025: the use of an artificial intelligence system is declared clearly and intelligibly to the recipient of the service. That declaration appears at the head of the dialogue window, before any interaction.

Cookies and local storage

What gets saved in your browser, and why it amounts to very little

01

What cookies and similar tools are

Cookies are small files that a site stores in the user’s browser. Alongside them sit equivalent tools, such as the browser’s local storage, which this site uses instead of cookies.

02

What this site stores

dm_lang — local storage: holds the selected language. Permanent until the browser data is cleared.

dm_ck — local storage: records that the notice at the foot of the page has been read. Permanent until the browser data is cleared.

Viewing settings of the 360° tours — local and session storage of the viewer: they hold the camera position and the navigation mode for the duration of the visit. They contain no identifier and do not leave the device.

No session cookie, no analytics cookie and no profiling cookie is set.

03

Third-party cookies

None. The site loads no external typefaces, embeds no maps, videos or widgets, and uses no statistics tools.

A technical check on 12 October 2026 confirmed that the page makes no request to any domain other than its own.

The virtual tours are likewise served from the controller’s own domain: opening one puts the browser in contact with no other site. Two tours contain a link to a video on YouTube, which opens in a new tab solely upon the user’s action; until then YouTube receives no data.

04

Why no consent mechanism is presented

The tools listed above are exclusively technical: they serve the operation of the site in the selected language.

For such tools the law, and in particular the guidelines of the Italian supervisory authority of 10 June 2021, requires information but not prior consent. The notice at the foot of the page is therefore purely informative.

If the site ever adds statistics or third-party tools, a real consent banner with choices by category will appear, and this page will be updated first.

In that event the two buttons will be of equivalent size, colour and prominence; the close control at the top will dismiss the notice without installing anything; and where consent is refused the notice will not be presented again for at least six months, unless the conditions of the processing change.

05

Classification criterion

The guidelines require the criterion of classification to be stated, and not merely its outcome. The criterion adopted is as follows.

Technical: those tools in the absence of which the requested service does not work, or works less well — the selected language, the memory of the notice, the camera position within a tour. These require no consent under Article 122 of Legislative Decree 196/2003.

Analytics: they count visits. Without IP truncation or when combined with other processing they must be treated as profiling tools. The site uses none today.

Profiling: they reconstruct behaviour for advertising. None are present and none are planned.

06

Erasure

Through the browser settings, under privacy or site data, the data of this site may be erased or its storage prevented.

After clearing, the site returns to its default language and the notice at the bottom appears once more.

07

Duration and nature of what is stored

dm_lang and dm_ck are local storage entries and not cookies: they are not sent to the server with every request, they remain on the device and they have no automatic expiry. They are removed together with the site data.

No unique identifier is set. Two different visitors store exactly the same content, for instance the string it or ru: they cannot be told apart or followed over time.

08

Where to clear it, browser by browser

Chrome: Settings, Privacy and security, Cookies and other site data, See all site data.

Safari: Settings, Privacy, Manage website data.

Firefox: Settings, Privacy and security, Cookies and site data, Manage data.

Edge: Settings, Cookies and site permissions, Manage and delete cookies and site data.

Alternatively, browsing in a private or incognito window keeps nothing once the session ends.

09

The automatic assistant

The assistant uses no cookies and stores no identifier. Until it is started, no request is made to any external service.

The text of the conversation remains in the memory of the browser tab, not in local storage, and is lost when the tab is closed. No identifier permits recognition on a subsequent visit.

10

The 360° virtual tours

A tour does not load automatically: until the still is pressed, the page carries a photograph and nothing else. On opening, the viewer records certain viewing settings on the device, such as camera position and navigation mode; those entries remain in the browser, are transmitted to no one, and are removed together with the site data.

In two tours an element links to a video on YouTube. This is a hyperlink and not embedded content: it opens in a new tab only upon the user’s action, and from that point the terms and notice of YouTube (Google Ireland Limited) apply, outside the controller’s control.

02

What this site is

The site presents a professional practice. It is not an online shop: nothing can be bought here, no payment is taken and no order is recorded.

No contract is concluded through these pages.

03

Prices and quotes

The amounts shown are indicative, in euro, and do not include any travel costs. They are not an offer to the public within the meaning of Article 1336 of the Italian Civil Code.

The only binding document is the written quote, sent after the job has been assessed, together with its contract. The quote arrives within three days of first contact and the price holds for the period stated in the quote itself.

The site publishes two price lists: one for businesses, professionals and bodies holding a partita IVA, and one for private clients. The list applied is the one matching the client’s status, as stated in the quote and in the contract. Private clients pay a deposit of 30 per cent when the contract is signed and the balance by bank transfer before the files are delivered; the electronic invoice is made out to their codice fiscale. Businesses receive the electronic invoice at their partita IVA, with recipient code or PEC, and pay within the terms set in the contract.

The owner works under the Italian flat-rate regime: transactions are not subject to VAT under Article 1, paragraphs 54 to 89, of Law 190 of 23 December 2014 as amended, and no withholding tax applies under paragraph 67 of the same article. The agreed price is therefore the final amount.

04

The calculators on this site

The light-hour calculator performs an astronomical calculation in the user’s browser, on the basis of the locality, date and orientation indicated.

It takes no account of the terrain, the surrounding buildings, the vegetation or the weather. Its results are indicative only and constitute no guarantee as to the light on any given day.

05

Intellectual property

All content on this site, namely photographs, videos, virtual tours, texts, graphics, layout, code, the DAMONTE name and logo, the names and structure of the services and the overall presentation, is protected by Italian Law no. 633 of 22 April 1941, by Articles 2575 et seq. of the Italian Civil Code, by the Italian Industrial Property Code (Legislative Decree no. 30 of 10 February 2005) and by European and international law. All rights are reserved to the site owner or the respective rights holders.

Without written permission it is forbidden to download, save, copy, reproduce, crop, modify, translate, distribute, publish, sell or otherwise use, in whole or in part, the photographs, videos, tours, texts and graphics of the site, including on social networks, property portals, listings and advertising, and to remove authorship information from the files.

Text and data mining is also forbidden, including use to train artificial intelligence systems: under Article 70-quater of Law no. 633/1941 and Article 4 of Directive (EU) 2019/790, the owner expressly reserves this use.

Ideas as such are not protected by copyright. Their form of expression, the texts, the selection and arrangement of the content and the concrete realisation of the site’s formats, such as “The flight”, are. Slavish imitation of the site or appropriation of its merits may constitute unfair competition under Article 2598 of the Italian Civil Code. The owner reserves every action to protect these rights, including interim relief, and the right to compensation.

You may browse the site for personal use and share its link. The rights to use images made for a client are set out in the contract for that job. Reports of unauthorised use can be sent to info@damonte.net.

06

Images on the site are illustrative

The photographs, videos and images published on the site are illustrative: they show the owner’s style, light and working method. Unless stated otherwise, they do not depict the property, premises or business of any specific client and do not constitute an offer for sale or rent.

Some images are created or edited with digital tools, including artificial intelligence systems. The photographs delivered to clients, by contrast, depict the places actually photographed and are post-produced without altering their real condition.

07

Permitted use of the site

The site may be consulted for personal and informational purposes and its address may be shared freely.

Unless the owner gives written permission, it is forbidden to: systematically extract or re-use the content, including by automated programs; display the site or parts of it inside other sites (framing) or load its files from third-party servers (hotlinking); decompile or reproduce the code; interfere with the operation of the site or attempt to access non-public areas.

It is forbidden to remove or alter electronic rights-management information and technological protection measures contained in the files, under Articles 102-quater and 102-quinquies of Italian Law no. 633 of 22 April 1941. The owner also protects the database rights under Articles 102-bis et seq. of the same law.

08

External links

The pages contain links to WhatsApp and to an email address. Following those links, the user leaves this site and enters services operated by third parties, subject to their own terms and notices.

The controller is not answerable for the content or the operation of third-party services.

09

Liability

The owner takes care that the information is accurate and up to date, but does not warrant that the site is free from errors, always available or free from harmful components.

To the extent permitted by Article 1229 of the Italian Civil Code, the owner is not liable for direct or indirect damage arising from access to the site, from its unavailability or from reliance on the information published, save in cases of wilful misconduct or gross negligence.

A user who uses the site or its content in breach of these terms shall hold the owner harmless from any claim, damage, cost and expense arising therefrom, including legal fees.

Nothing in these terms limits the rights granted to consumers by Italian Legislative Decree no. 206 of 6 September 2005 (Consumer Code), nor any liability that cannot be excluded by law.

10

Governing law and jurisdiction

These terms are governed by Italian law.

For disputes with a consumer, the court of the consumer’s place of residence or domicile has jurisdiction. For disputes with a professional or a company, the court of the controller’s registered office has jurisdiction.

Alternative dispute resolution bodies entered in the registers kept by the competent Italian authorities remain available.

11

Binding version and changes

The site is published in six languages. Where versions differ, the Italian text prevails.

These terms may change. The version that applies is the one published on this page on the date shown at the foot.

12

Consumer right of withdrawal

Where the user is a consumer and the agreement is concluded at a distance or off premises, in particular through WhatsApp or email, the consumer has fourteen days to withdraw without giving reasons, under Articles 52 et seq. of Legislative Decree 206/2005.

The period runs from the day the agreement is concluded. The right is exercised by written declaration sent to info@damonte.net.

In the event of a valid withdrawal, the deposit paid is refunded within fourteen days of the notice, by the same means of payment the consumer used, less the proportional amount for any part of the service already performed at their express request.

Where the consumer expressly requests that performance begin before the period expires and the service is performed in full, the right of withdrawal is extinguished, under Article 59(1)(a). Where performance has begun but is not complete, the amount proportionate to the service already rendered is due.

The right of withdrawal does not apply to contracts with professionals, companies and institutions.

13

Who obtains permission to shoot

The client warrants that they have the right to have the place photographed and to authorise access, and undertakes to obtain the necessary permissions in advance: the building management, the owner, the shopping centre management, the body in charge.

Italy has no general freedom of panorama. Commercial reproduction of cultural property and of its settings may require authorisation from the body that holds it, under Articles 107 and 108 of Legislative Decree 42/2004. Where this applies, the client obtains it, or instructs the controller in writing to apply for it.

If a permit is missing on the day, the shoot is rescheduled and any costs already incurred remain payable.

14

People in the pictures

Where identifiable people appear, consent to publish their image is obtained beforehand, as Article 10 of the Civil Code and Articles 96 and 97 of Law 633/1941 require.

Where the shoot involves the client’s staff, guests or customers, it is the client who informs them and obtains their consent, and who states this in the contract.

In sports shoots the client, whether club, team, federation or organiser, warrants that it has obtained the consent of athletes, staff and officials and, for minors, of those with parental responsibility, and that it has access to the venue. The audiovisual rights to competitions belong to the organiser under Legislative Decree no. 9 of 9 January 2008: the related authorisations are the client’s responsibility. The drone does not fly over assemblies of people, as Regulation (EU) 2019/947 requires.

Anyone appearing in an image may ask for it to be removed from the controller’s channels by writing to info@damonte.net.

15

Drone work

Flights are carried out by a registered and insured operator, in compliance with the European regulation and the applicable ENAC provisions.

Flight zones are checked before signing. Where flight is not permitted, or where authorisations do not arrive in time, the job proceeds without aerial footage and that part is not charged.

The controller may refuse a flight that would be unlawful or unsafe, including after signature, and this is not a breach of contract.

16

Weather, postponement and force majeure

Exterior work depends on light and weather. If conditions would make the result inadequate, the shoot moves to the next agreed date at no extra cost for the postponement.

Neither party is liable for failure to perform caused by matters beyond its reasonable control: natural events, orders of public authorities, network or power failures, documented illness.

If an agreed date is cancelled by the client with less than forty-eight hours’ notice, costs already incurred and documented remain payable.

17

Timing, delivery and archive

The times stated in the quote run from the day after the shoot and are counted in working days.

Delivery is by download link. Files stay available for twelve months; beyond that, storage is not guaranteed and the client is advised to archive them.

Any observations about the delivery should be raised within fifteen days of receipt.

18

Contract and signature

Every job is governed by a written contract in Italian. The contract may be signed electronically, with an advanced, qualified or digital electronic signature under Regulation (EU) No 910/2014 (eIDAS) and Articles 20 and 21 of Italian Legislative Decree No 82 of 7 March 2005 (Digital Administration Code), or by handwritten signature on a paper copy. Either way the contract satisfies the written form and has the effect provided for by Article 2702 of the Italian Civil Code.

For an electronic signature the client receives the contract by email, signs it from a phone, tablet or computer with a confirmation code or with their own digital signature, and at once receives the signed copy as a PDF. For a handwritten signature the owner brings the printed contract in two originals and each party keeps one. Translations of the contract are provided as a courtesy; the Italian text prevails.

19

Final clauses

If an individual clause is void or unenforceable, the others stand and that clause is replaced by the lawful one closest to the parties’ intention.

Neither party may assign the contract to a third party without the other’s written consent.

Failure to exercise a right is not a waiver of it.

These terms are drafted in Italian and translated as a courtesy. Where versions differ, the Italian text prevails.

20

The automatic assistant binds nothing

The assistant answering on the site is an automatic system. What it says is informative: it is not a quote, it is not an offer to the public within the meaning of Article 1336 of the Italian Civil Code, and it does not bind the owner.

The orders of magnitude the assistant gives come from the published price list and are worth what the price list is worth: the only binding document remains the written quote, with its contract.

The assistant does not confirm dates, does not accept commissions and does not conclude contracts. The availability of a date is confirmed by the controller in writing.

21

Gift cards

A gift card is valid until the expiry date shown on it or, if none is shown, for twelve months from its issue date. It is used for the services stated, or up to its amount, in a single booking; the date of the shoot is agreed with the owner according to availability.

A gift card cannot be exchanged for cash and no change is given. It may be passed to another person, provided the owner is told before the booking.

22

Design and development of the site

The damonte.net website was designed and developed by VERDE WAHHE APP (Ventspils, Latvia, verdewahheapp.com), which also handles its search engine optimisation (SEO), its optimisation for AI-based answer engines (GEO) and its technical performance. VERDE WAHHE APP is a digital studio that designs and builds websites, web and mobile applications and custom interactive tools: from project and user-experience analysis to interface design, from multilingual development to traffic and conversion analytics, through to maintaining and growing the site over time.
